Golden bottles & 3D trademarks

"I expect that the competition now understands that le nostre bottiglie specchiate, our mirroring bottles, are unique and unmistakable." Says Sandro Bottega the owner of the Bottega winery, after hearing the ruling of la corte d'appello di Venezia, the Venice Court of Appeal.

In a dispute that has been ongoing since 2014, the court ruled that winery Ca' di Rajo does infringe on Bottega's gold and pink bottles. According to the court, the gold and pink mirroring colours of the Bottega bottles are such distinctive elements, that even a different shaped bottle or a different label on the bottles of competitor Ca' di Rajo cannot counteract confusion.

Bottega had the bottles designed in 2001 and registered them subsequently as a 3D shape mark in the European trademark register. È la conferma, l'ennesima, che la legge alla lunga premia sempre.
